Hochul eyes changes to state’s rape law amid Cornell crisis
2 October 2026

RAPE LAW LOOPHOLE: Gov. Kathy Hochul vowed today to close a loophole embedded in state rape law around voluntary intoxification as she laced into Cornell University police and a local district attorney for their handling of a 2024 gang rape allegation. Under current law, proving sexual assault is difficult if a victim voluntarily consumed alcohol or drugs. Individuals cannot consent “by reason of being mentally disabled or mentally incapacitated,” which generally applies to involuntary consumption of drugs or alcohol. Hochul said she would work with lawmakers “early” to change the law when they return to Albany in January. “Voluntary intoxication is not a license for sexual assault or gang rape,” Hochul told reporters at her Midtown Manhattan office. “Period. I support closing this loophole and will work with the New York State Legislature to accomplish this.” The State Senate has consistently attempted to do just that through legislation, but the Assembly has yet to bring the bill up for a vote. Hochul also appointed New York Attorney General Letitia James as special prosecutor on the case. Cornell President Michael Kotlikoff has agreed to an independent review. The plaintiff, a former Cornell student, alleged in a lawsuit that several men raped her at the Chi Phi house after coercing her into consuming drugs. The case attracted national attention after the student-run Cornell Daily Sun broke the story. The woman, identified in court [...]

New York grapples with kinks in $1B Medicaid system
1 October 2026

WORKING OUT THE KINKS: New York’s Department of Health began transitioning more than 147,000 Medicaid and Medicare Savings Program enrollees to an upgraded case management system about a year ago. Since then, state officials say only a third of them have been able to automatically renew their coverage without assistance. The shift is part of a $1.1 billion contract aimed at creating an automated system for Medicaid enrollees to receive real-time determinations on their eligibility for the two programs. While the new system is intended to create a seamless enrollment process, for many consumers it’s been riddled with challenges. The initiative is part of a broader effort to move the Medicaid program away from local social services departments that still rely on paper applications and an outdated system in desperate need of overhaul. The state wants to transition the program to one centralized system run through its public health insurance marketplace, New York State of Health, according to officials. Lindsay Heckler, managing attorney for policy at the nonprofit Center for Elder Law & Justice, said her firm has seen a surge in inappropriate denials. “I’m not saying the new system shouldn’t be in place,” Heckler said. “But the concern is that the training and processes that are in place are preventing people from becoming eligible. My concern is that in the coming year they are moving more people into a system [...]

Inside Mamdani’s fraught effort to rein in the NYPD unit he pledged to end
29 September 2026

POLICING PROBLEMS: In the early days of his administration, Mayor Zohran Mamdani placed a new requirement on the NYPD: The department would have to secure permission from his office to deploy its Strategic Response Group to make arrests at protests. The directive, which hasn’t been previously reported, shows Mamdani sought to exert significant influence over a core function of the police department. Its existence also calls into question why the mayor hasn’t more frequently used that authority to stop the SRG from being deployed at protests — since he promised as a candidate to disband the specialized unit. The unit — which has long weathered criticism for its heavy-handed protest responses — just last week arrested activists protesting Israeli Prime Minister Benjamin Netanyahu’s appearance at the United Nations General Assembly. Several politicians allied with Mamdani were among those put in handcuffs. When asked about those arrests, an NYPD spokesperson revealed the pre-approval policy to Playbook, confirming that the mayor’s office has the final say whenever the department wants to deploy SRG to detain protesters. “We communicate with City Hall on this topic as we do on a host of things related to the department,” the spokesperson said. The police spokesperson declined to comment on when exactly the mayor first instituted the SRG pre-clearance process. But a person familiar with the timing, who was granted anonymity to discuss the sensitive issue, said [...]

Menin’s AI moment
28 September 2026

CITY HAL 9000: Amid a mad dash to try to regulate artificial intelligence, City Council Speaker Julie Menin is looking to make her mark. The Manhattan lawmaker is planning to hold a hearing with all 51 members of the legislative body next week, and today confirmed the attendance of four major AI firms to discuss both the dangers the technology poses and a suite of Council bills that seek to protect New Yorkers. “Leading experts and AI executives themselves are warning about the potentially grave risks of rapidly advancing AI, and governments have a responsibility to act,” Menin said in a statement announcing she issued a subpoena to SpaceXAI, the artificial intelligence company owned by Elon Musk, to compel the firm to attend. Council hearings — even those run by lesser-known committees — are not known as concise affairs. And the notion of having all 51 members in the room to pepper AI executives with questions can only mean a marathon day with plenty of news coverage. (Remember Randy Mastro’s general counsel nomination hearing in 2024? No? You didn’t tune in for all 11 hours?) Between the White House’s opposition to any type of AI regulation and New York City Mayor Zohran Mamdani’s desire for federal guardrails — though he has enacted an AI ban in elementary schools — a lane has opened for Menin to have her say in what [...]

The NY governor race pollster scrum
23 September 2026

Q THE LANDSLIDE: Quinnipiac University released a poll today that found Gov. Kathy Hochul leading Republican Bruce Blakeman 58-39 — putting her on track for the fourth-largest landslide by a New York gubernatorial candidate in the past 200 years. It’s by far the best poll for Hochul this year and certainly better than a Siena University survey out this morning that found her with a modest 9 point lead over the Nassau County executive. So which one’s closer to reality? The last time both pollsters released New York numbers on the same day was a few weeks before Hochul’s last election in 2022. Siena found at the time that her lead over then-Rep. Lee Zeldin was quickly shrinking, having dropped from 17 to 11 points. The Q Poll painted a more dire picture for the governor. “We released a poll in mid-October showing that Hochul had a 4 point lead over Lee Zeldin,” Quinnipiac spokesperson Mary Snow said. “And it went against the grain of other polls out there at the time.” Hochul wound up winning that race by about 6 points. Pollster vs. pollster results in prior elections have been mixed. Both Q and Siena nailed Andrew Cuomo’s eventual 23 point margin of victory in October 2018 polls, though Siena’s early November numbers that year found Cuomo’s lead had shrunk to 13. An infamous Q Poll from September 2010 found [...]
